Return of penalties for non-registration of residence

The government plans to reintroduce penalties for failing to comply with the registration of residence obligation. In 2013, the penalties were abolished. Prior to this year, the following article of the Petty offences code was in force:

Article 147 § 1, a person who fails to comply with the registration of residence obligation is liable to a restriction of liberty, a fine or a reprimand.

The same provision is expected to return to the Petty offences code later this year, according to the government’s announcement. Particularly noteworthy is the fine, which is calculated, among other things, on the basis of the convicted person’s wealth criterion, which may entail severe consequences for residents’ wallets.

Registration of residence can be obtained:

  • in an office or online,
  • in person or by a representative

The registration obligation applies to Polish citizens and foreigners residing on the territory of Poland. The resident has 30 days to fulfil the registration obligation from the day of arrival at the place of residence.
